1.2. The Website is operated by The CPD Register Ltd, a company registered in England and Wales under company number 13075495, with its registered office at International House, 6 South Molton Street, London W1K 5QF (referred to in these Terms as "we", "us", or "The CPD Register").

1.3. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website.

1.4. We may update these Terms from time to time. The date of the most recent update is shown at the foot of this page. Your continued use of the Website after an update constitutes acceptance of the updated Terms.

2.1. The following separate documents apply to specific functions of the Website and services we offer. Where any of these documents governs your use of a particular function, that document takes precedence over these Terms in relation to that function:

  • Listing Policy — governs the compilation, publication, correction, and removal of listings of CPD Accreditation Organisations on our public register
  • Certification Agreement — governs the relationship between The CPD Register and organisations that have been granted certification under our voluntary certification scheme
  • Investigation Service Terms — governs submissions made to and investigations carried out under our consumer investigation service at https://thecpdregister.com/report
  • Privacy Policy — governs how we collect, use, and protect personal data

2.2. All of the above are available from the footer of every page of the Website.

3. What The CPD Register is

3.1. The CPD Register is an independent Certification Body operating under UK Intellectual Property Office Certification Mark status. We operate a voluntary certification scheme for CPD Accreditation Organisations, publish a public register of CPD Accreditation Organisations operating in the UK market, and provide an investigation service for consumers with concerns about CPD courses or accreditation.

3.2. Certification with The CPD Register is voluntary. We are not a statutory regulator and we do not hold enforcement authority over CPD Accreditation Organisations or training providers.

4. Permitted use of the Website

4.1. You may use the Website to:

  • View and read content published by us, including our public register, methodology, and other published materials
  • Submit a correction request for information published on the public register, in accordance with the Listing Policy
  • Submit a concern or complaint through our Investigation Service in accordance with the Investigation Service Terms
  • Apply to be certified by The CPD Register in accordance with the Certification Agreement
  • Contact us for any other legitimate purpose

4.2. You must use the Website in accordance with applicable laws and these Terms.

5. Prohibited use of the Website

5.1. You must not:

  • Use the Website in any way that breaches any applicable local, national, or international law or regulation
  • Use the Website in any way that is unlawful, fraudulent, or has any unlawful or fraudulent purpose or effect
  • Use the Website to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material
  • Use the Website to knowingly transmit any data, send or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware

5.2. You specifically agree that you will not:

  • Systematically scrape, harvest, extract, or copy content from the Website, including the public register, by automated or manual means, for the purpose of creating or compiling any comparable database, register, directory, or competing product
  • Access, or attempt to access, any area of the Website, database, computer system, or network for which you have not been granted permission
  • Interfere with, damage, or disrupt any part of the Website, or any equipment or network on which the Website is stored
  • Use the Website to impersonate any other person, or to misrepresent your affiliation with any person or organisation
  • Frame, mirror, or otherwise reproduce the Website or any material from the Website on any other website without our prior written permission

5.3. We monitor use of the Website and reserve the right to investigate any suspected breach of these Terms. We may report suspected breaches to the relevant authorities and will cooperate with those authorities in any investigation.

6. Our intellectual property

6.1. The Website and all content published on it, including (but not limited to) text, graphics, logos, images, page layout, underlying code, software, and compilations of data, is owned by The CPD Register Ltd or licensed to us by third parties. All such material is protected by copyright, database rights, trade mark rights, and other intellectual property laws of the United Kingdom and internationally.

6.2. You may:

  • View, read, and print material from the Website for your own personal, non-commercial use
  • Share links to pages on the Website
  • Cite or quote reasonable short extracts of published content with clear attribution to The CPD Register and, where practical, a link to the source page

6.3. Unless expressly permitted by these Terms or with our prior written consent, you may not:

  • Reproduce, copy, distribute, republish, download, display, post, or transmit content from the Website in any form or by any means
  • Use any content from the Website for commercial purposes, including in any commercial publication, training material, or promotional activity

6.4. Our trade marks, including "The CPD Register" and any associated logos and Certification Mark, are registered and unregistered trade marks of The CPD Register Ltd. You may not use our trade marks without our prior written consent, except that certified organisations may use our Certification Mark in accordance with the Certification Agreement.

7. Links to third-party websites

7.1. The Website contains links to third-party websites, including (but not limited to) Companies House, the Information Commissioner's Office, regulatory bodies, and the websites of CPD Accreditation Organisations listed on our public register.

7.2. Links to third-party websites are provided for information only. We have no control over the content of third-party websites and accept no responsibility for their content, accuracy, security, or availability.

7.3. The inclusion of a link to a third-party website does not constitute an endorsement of that website, its content, or the party controlling it.

8. Information on the Website

8.1. We take reasonable care to ensure that information published on the Website is accurate at the time of publication. However, the Website contains information drawn from public sources, including Companies House, the Information Commissioner's Office, regulatory registers, court judgments, and the published material of third parties. The accuracy and currency of information drawn from these sources is the responsibility of the originating source.

8.2. We do not warrant or represent that:

  • Information on the Website is complete, accurate, current, or free from error
  • The Website will be available without interruption
  • The Website is free from viruses, malware, or other harmful code

9. The public register

9.1. The CPD Register publishes a public register of CPD Accreditation Organisations operating in the UK market at https://thecpdregister.com/cpd-accreditation-organisation-ranking (the "Register").

9.2. The compilation, publication, correction, and removal of entries on the Register is governed by our Listing Policy, which is available at https://thecpdregister.com/listing-policy.

9.3. Organisations listed on the Register who wish to request a correction to the information published about them should do so in accordance with the Listing Policy. We respond to evidenced correction requests within five working days of receipt.

9.4. The Register is published as a matter of public interest transparency about the UK CPD accreditation sector. Inclusion on the Register does not imply endorsement by The CPD Register, nor is non-inclusion an adverse finding.

10. Our liability

10.1. Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited or excluded by applicable law

10.2. Subject to clause 10.1, The CPD Register's total liability to you in connection with your use of the Website is limited to £100.

10.3. Subject to clause 10.1, we are not liable for:

  • Any indirect, special, or consequential loss
  • Any loss of profits, revenue, business, opportunity, goodwill, or anticipated savings
  • Any loss or corruption of data
  • Any loss arising from your reliance on information published on the Website

10.4. The limitations in this clause 10 apply to the fullest extent permitted by applicable law. Nothing in these Terms affects your statutory rights as a consumer.

11. Indemnity

11.1. You agree to indemnify, defend, and hold harmless The CPD Register, its directors, officers, employees, and agents against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms
  • Your misuse of the Website
  • Your infringement of any third party's rights through your use of the Website

12. Changes to the Website

12.1. We reserve the right to change, suspend, withdraw, or discontinue any aspect of the Website at any time, for operational, technical, legal, or commercial reasons. We will give reasonable notice of material changes where practical to do so.

13. Suspension or termination of access

13.1. We reserve the right to suspend or permanently prevent access to the Website by any user who breaches these Terms, at our sole discretion.

13.2. Where we exercise this right, we will notify the user by email where we hold contact details, stating the reason for the decision.

14. Complaints about the Website or our services

14.1. If you wish to make a complaint about the Website or any service provided by The CPD Register, please contact us at [email protected]. We aim to acknowledge complaints within two working days and provide a substantive response within ten working days.

14.2. Complaints about the content of a listing on the Register should be made in accordance with the Listing Policy, which sets out the correction and removal process.

15. Governing law and jurisdiction

15.1. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales.

15.2. The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

15.3. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts and the relevant local law may apply to the extent required by that local law.

16. General

16.1. If any provision of these Terms is held to be unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

16.2. A failure by us to enforce any provision of these Terms does not constitute a waiver of that provision.

16.3. These Terms are personal to you and may not be assigned or transferred without our prior written consent.

16.4. These Terms, together with the other documents referred to in clause 2, constitute the entire agreement between you and us in relation to your use of the Website.
